Terms of Service for Image3D AI

1. Description of Service

Image3D AI ("we", "us", or "our") provides an AI-powered Software-as-a-Service (SaaS) platform that allows users to convert 2D images (single or multi-view) into 3D models (such as .STL, .OBJ, and .GLB files). Our Service utilizes third-party AI models, including but not limited to Tencent's Hunyuan 3D, to process and generate this content.

2. User Accounts

You may need to register for an account to access certain features of the Service (such as paid plans). You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account.

3. User-Generated Content (Your Content)

This section is critical and covers both what you upload and what you create.

Your Input: You retain all ownership rights to the 2D images and other content you upload to the Service ("Input").

Your Output: You retain all ownership rights to the 3D models generated by the Service from your Input ("Output"). You are free to use your Output for any purpose, including commercial purposes.

License to Us (Image3D AI): To provide you with the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process your Input. This license is solely for the purpose of:

• Operating, providing, and improving the Service.
• Generating your Output.
• Transmitting your Input to our third-party API providers (like Hunyuan 3D) for processing.

This license terminates when you delete your content from our Service.

Your Responsibility: You represent and warrant that you have all necessary rights, licenses, and permissions to upload your Input and that your Input does not infringe on the intellectual property rights or privacy rights of any third party.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload, create, or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.
• Upload, create, or share any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party. (e.g., uploading a copyrighted logo you do not own).
• Upload any images containing personal data or sensitive information of individuals without their explicit consent.
• Reverse-engineer, decompile, or otherwise attempt to discover the source code of the Service or the underlying AI models.
• Use any automated system (bots, scrapers) to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

5. Payments, Subscriptions, and Refunds

Paid Services: We offer both free and paid services. Features and pricing for paid services (e.g., subscriptions or pay-as-you-go credits) are described on our Pricing page.

Billing: We use a third-party payment processor (e.g., Creem) to bill you. All payments are subject to the terms of the payment processor.

Auto-Renewal: Subscription plans may auto-renew unless canceled before the renewal date.

Refunds: Due to the computational cost of AI generation, payments for services already rendered are generally non-refundable. Please see our Refund Policy Page for details.

6. Third-Party Services (Hunyuan 3D)

Our Service relies on third-party APIs, including Tencent's Hunyuan 3D, to function. By using our Service, you acknowledge that your Input will be sent to these third-party services for processing. We are not responsible for the privacy practices, availability, or accuracy of these third-party services.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You may terminate your account at any time by contacting us or through your account settings.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or secure.

AI-Specific Disclaimer: You understand that AI model generation is a novel and experimental technology. The generated Output (3D models) may contain inaccuracies, artifacts, or may not perfectly match your expectations or Input. We make no guarantees as to the quality, accuracy, or suitability of the Output for any specific purpose.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IMAGE3D AI (OR ITS OWNERS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICE; (B) ANY ERRORS OR INACCURACIES IN THE GENERATED OUTPUT.

10. Governing Law

These Terms shall be governed by the laws, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect.
